Question abou a foster homes ownership of an animal.

A few months ago my family and I found a litter of kittens. We didn’t know what to do with them but we knew I wanted one because I was moving out soon. They were too small for us to take care of so we took them to a foster care place my mom knew of. At first the lady seemed really nice about everything and even said I was guaranteed to have my kitten which was a little grey kitty no questions asked I just had to fill the paperwork out.

Once the kittens grew up a little we were able to take the kittens in to foster at our house. All except the little grey one I wanted stayed downstairs and the grey one stayed with me. A month went by and I moved out and took the grey cat with my. She’s lived with me and my roommate for a month now and we love her to death.

My mom was supposed to take the kittens to get spayed and neutered today so she did but she didn’t answer her phone while she was driving and she was like 5 minutes late. The lady proceeded to blow up her phone and call and text constantly during this time. After which she was mad at her for being 5 minutes late even though she had been a perfect foster home.

Once my mom gave the kittens over to the vet the vet said the lady told her to not give the kittens back and they didn’t need her anymore. My mother was devastated. She had spent 2 and a half months taking care of these kittens just to have them taken with no good bye or anything even though she was promised one. When the lady was contacted about this she said “you can see them when they’re at pet smart” and that was all.

I don’t know if I should take my cat to get spayed at the time the lady told me to or not. I don’t trust her to keep her word because she didn’t with my mom. Does she have any legal ownership of this cat, or can I just keep her and do everything myself?

Tl;dr: crazy foster lady didn’t keep her word about kittens that were fostered and promised my mom a goodbye and didn’t get one. I have a cat from this litter so should I keep it and take it on my own?

Edit: I am also paying extra on my rent and made a deposit for this cat
