Help! The puppy we adopted picked up distemper from the shelter before we adopted him. Looking for advice

Hello r/pets!

Looking for advice from any vets or fellow puppy parents who’ve dealt with this.

Some (long) background info in case it’s relevant:

We adopted our beautiful 12 week old shepherd mix puppy last Monday 10/25. He had symptoms of kennel cough and we went home with Doxycycline which we were to give him through the end of the week. We have an older 7 year old who shep mix at home that we weee told to keep the puppy away from for a couple days before we introduced them. We did our best to keep them separate at home until Wednesday when we formally let them play with each other. The puppy was very active, hyper and alert through Friday. He had nasal discharge that wasn’t getting better with doxy, but we figured it was just taking a while. Our older dog also battled kennel cough as as puppy so I figured this was just a more severe version. Saturday 10/30 AM we took both the dogs to our family vet to get checked out and give the pup his Leptospira vaccine (he already had his first set of shots). That afternoon we got the call that one of the puppies that ours came to the shelter with tested positive for distemper and we should come by to get him tested. At this point the pup was a little lethargic which we figured was cus of the vaccine. His nasal discharge was pretty bad at this point and his respiratory rate increased as well. Sunday his condition was more or less the same. Poor guy gave it his all and came out for a short walk. That afternoon he had diarrhea and we started getting worried. We decided to be proactive and admit him to the local emergency hospital. $3000 later, He responded well to antibiotics and we got him back the next day (Monday) and he was back to being chirpy and eating again.

Tuesday the shelter called us asking for an update and we told them that he was doing ok not great and they advised us to give him back to the shelter so they could care for him. Since then he’s been doing well and responding to antibiotics. Today we got the news that the test came back positive for distemper. They said we could foster him so we wouldn’t have to pay for his expenses with the caveat that things could still turn for the worse even though he’s responding well right now. And if in 3-4 weeks if he tests negative we can adopt him. Initially We were all for it, but after consulting with our vet he said it’s better not to unnecessarily expose our older dog to distemper even tho she has all her shots and so far hasn’t shown any symptoms.

My questions to you guys is: - should we expect him to make it? Or just not get our hopes up? I’ve heard mixed things about puppies making it out. Does anyone have any insight - my older dog is vaccinated. If she tests positive for distemper, is she likely to not show symptoms? If somethjng happens to our older dog, I might actually consider legal action.
