There is a post on my community's FB page concerning a dog that was hit by a motor vehicle. The unrestrained dog got into the road and was hit by a passing pick-up truck that did not stop. From the sounds of it, it is possible the driver did not know a dog was hit. The dog owner is understandably distraught and angry. They want to "catch" the driver who did this. I'm curious what, if any responsibility or liability the driver has in this situation. My perspective is that the owner has an absolute responsibility to restrain the dog to keep it safe from dangerous situations. This happened in a semi-rural area where there are no leash laws. It is my understanding that dogs must be restrained in public nevertheless. What actual liability does the driver have? I think the driver has zero liability. No crime was committed. The driver has no responsibility to the dog owners. What do they think is going to happen if they "catch" the driver?
