Should a shelter pay vet costs if they knowingly adopt out a sick oet without telling you?

Basically, I just got two kittens and in 90% sure one has had a URI since they day we got her. No one disclosed this to me until I asked them about it last week. It has been three weeks and she still sneezes, is congested, sometimes squints an eye, etc. If I end up having to take her to the vet after getting the free physical, should I talk to the shelter about reimbursement?

As a side question, is 3-4 weeks for a URI concerning at all? She still has energy, eats, drinks, no eye discharge, etc.
