My dog got attacked last weekend and I need advice

Last weekend my girlfriend and I took our dog right outside of our apartment to potty. We were barely outside when we saw a man and his off-leash dog no more than about 10-15 yards away. The off-leash dog hopped the barrier going around the perimeter of the complex and attacked my dog, clamping down on his neck and pinning him to the ground. After a struggle we managed to get them separated. My dog is doing okay and sustained several lacerations to his leg and neck that required sutures and for him to wear a cone for two weeks. Our vet bills are currently in excess of $1000.

Here’s where the advice comes into play: my girlfriend and I want to take this dog owner to civil court. There are security cameras for the apartment complex and the nearby business that were able to easily capture what took place. However, the animal protection unit that came out refused to write the off-leash dog owner a citation because they didn’t see it take place. The businesses will not share the video footage unless the police contact them, and the animal protection unit are refusing to cooperate and communicate with these businesses to obtain the footage. We are kind of at a loss because we want justice for our dog, know that the evidence we need is within easy access, and for reasons beyond our control cannot obtain the video footage.

Has anyone here dealt with a dog attack before? If so, do you have any suggestions on how to proceed from here?
