Help with my neighbor who doesn't like my cat, Sylvester!

My neighbors across the street really do not like our cat Sylvester. We let Sylvester roam around the neighborhood during the daytime, and keep him inside at nighttime. Unfortunately, my neighbor has threatened to trap my cat in a cage and take him to the pound because he does not like Sylvester being in his yard. As a cat owner who wants the best for Sylvester, I can't lock him inside during the daytime (his previous owner let him come in and out through the cat door) because when he gets trapped inside he is miserable.

My 3 questions are this:

  1. Is it even legal for my neighbor to trap my cat and take him to the pound, knowing that he has owners? BTW I live in California.

  2. Being that Sylvester is microchipped, will the pound charge us a fee to retrieve Sylvester?

  3. Has anyone else dealt with a similar issue and had any success in keeping a cat out of someone else's yard?
